COUNTRY ROAD & TRENERY CARDHOLDER PROGRAM TERMS AND CONDITIONS

  1. The Terms and Conditions set out in this document concern the operation of Country Road/Trenery’s Cardholder Program, the use of the Cardholder Program card and any promotional activity and loyalty transactions that arise as a consequence of the Cardholder Program.
  2. Individuals who join the Cardholder Program agree to be bound by these Terms and Conditions.
  3. The most current Terms and Conditions at any point in time can be found at the following links: /cardholder-program/terms-and-conditions or /information-pages/terms-and-conditions.
  4. The Terms and Conditions may be modified at any time, without notification, by Country Road/Trenery at its absolute discretion. A modification to the Terms and Conditions may be applied to a Cardholder retrospectively (at Country Road/Trenery’s discretion).
  5. Country Road/Trenery is not liable or responsible for any email communication to any Cardholder that is misdirected, lost or not received.
  6. Country Road/Trenery is not liable or responsible for any Technical Issues that may cause damage to any computer related to or used in connection with the Cardholder program.
  7. Country Road/Trenery may collect personal information from Cardholders for the purpose of facilitating the Cardholder Program.  Personal information will be handled in accordance with the privacy policy of Country Road/Trenery – see /privacy-policy or /privacy-policy for more information.
  8. At its absolute discretion, Country Road/Trenery reserves the right to cancel, terminate, modify or suspend the Cardholder Program or any aspect of it at any time and without notice.
  9. Country Road/Trenery will not be liable for any tax liability incurred by a Cardholder in connection with the Cardholder Program, including any that may be incurred in relation to the provision and/or utilisation of Rewards.
  10. These Terms and Conditions are to be read in conjunction with any additional conditions associated with Rewards.
  11. Country Road/Trenery’s decision in relation to all matters arising in relation to the Cardholder Program is final and binding.
  12. Nothing in these Terms and Conditions is intended to contravene any applicable law.  To the extent that any provision in these Terms and Conditions is invalid or unenforceable, it is to be read down so as to be valid and enforceable, and otherwise must be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of these Terms and Conditions.

DEFINITIONS

  1. "Activation Date" means the date a Cardholder joins the Cardholder Program.
  2. “Anniversary” means the date 12 months from: a Cardholder’s Activation Date; or, the date that Cardholder changed their status, whichever is the later.
  3. “Cardholder” means an individual who is a member of the Cardholder Program.
  4. "Cardholder Program" means the loyalty program operated by Country Road/Trenery which provides loyalty program members with access to Rewards.
  5. "Country Road/Trenery" means Country Road Clothing Pty Ltd ABN 84 005 419 447 or its authorised representatives.
  6. “Spend Balance” means a Cardholder’s net cumulative spend (i.e. after all discounts, returns etc have been applied) on Valid Purchases in the previous 12 months.  For example, a Cardholder’s Spend Balance as at the period 1 March 2015 will be their cumulative spend on Valid Purchases during the period from 1 March 2014 to 23:59:59 on 28 February 2015.
  7. "Rewards" refers to rewards, vouchers or other benefits given to Cardholders as a consequence of purchasing behaviours, incentives and/or promotions.
  8.  "Technical Issues" means the technical malfunction of any telephone network, connection or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any web site or intranet site.
  9. "Terms and Conditions" mean the terms and conditions set out herein.
  10. “Valid Purchases” means all purchases, except purchases made at Outlet stores, outlet.countryroad.com.au, www.davidjones.com.au, towels purchased at Myer and David Jones stores, delivery costs and/or gift cards.  Any purchases which are returned will not constitute Valid Purchases. 
  11. "Website" refers to the Country Road and/or Trenery websites where details of the Cardholder Program (including the most up to date Terms and Conditions) can be found. The Website also provides a Cardholder with the ability to view status, online orders and to update their profile and email preferences.

OPERATION OF THE CARDHOLDER PROGRAM

  1. The Cardholder Program operates by attributing different Rewards (as nominated by Country Road/Trenery from time to time) to the various tiers of the Cardholder Program.
  2. Cardholders are allocated to tiers on the basis of their Spend Balance.
  3. When a Cardholder completes a transaction and identifies themselves in-store by presenting their loyalty card or photo identification, the net amount of the transaction is added to their Spend Balance on the day of order placement.
  4. When a Cardholder completes a transaction online and identifies themselves by logging into their online Cardholder account, the net amount of the transaction is added to their Spend Balance on the day of order dispatch, not at the time of order placement.
  5. When a Cardholder returns a purchase in-store or via post, the net amount of the transaction will be deducted from the Cardholder's Spend Balance.
  6. Cardholders are allocated to tiers on the basis of their Spend Balance (a Cardholder's 'status') in the following manner:
    1. VIP Cardholder status – given to Cardholders whose Spend Balance is AUD$2,500 or more;
    2. Loyalty Cardholder status –given to Cardholders whose Spend Balance is AUD$750 or more, but less than AUD$2500;
    3. Cardholder status – given to Cardholders whose Spend Balance is less than AUD$750; and
    4. New Cardholder status – given to new Cardholders for a period of 6 months immediately subsequent to their Activation Date and whose Spend Balance does not otherwise qualify them for Loyalty Cardholder or VIP Cardholder status. 
  7. A Cardholder may move at any time to a higher tier in the Cardholder Program when that Cardholder’s Spend Balance qualifies them to move to the higher tier. 
  8. On each Cardholder’s Anniversary, a Cardholder’s status until their next Anniversary will be determined by their Spend Balance.
  9. If a Cardholder’s Spend Balance is greater than that required to qualify for a particular tier, but less than that required to qualify for a higher tier, that excess spend will be carried forward and will be taken into account when calculating a Cardholder’s Spend Balance after the Cardholder’s next Anniversary. 
  10. All Valid Purchases will contribute to a Cardholder’s Spend Balance.
  11. Cardholders with ‘Cardholder status’ are eligible to receive the following Rewards:
    1. early access to and previews of sales and extra discounts on products not available to the public.  These will be issued from time to time by Country Road/Trenery at its discretion and on such terms as it sees fit;
    2. basic tailoring on full priced suit purchases. Basic tailoring includes free shortening or lengthening of jacket sleeves and pant/skirt hems only. The tailoring service is only available in-store at Country Road and Trenery stores (excludes David Jones, Myer and Outlet). This service is not available on event days and only available on lay-bys once paid in full. Cardholders must pay for all other tailoring alterations;
    3. first to know updates;
    4. a $20 ‘Welcome Voucher’ issued only once on the date the Cardholder first reaches Cardholder status from New Cardholder status.  This Welcome Voucher expires 60 days after date of issue;
    5. a $20 ‘Birthday Gift Voucher’, which expires 30 days after date of issue.  The Birthday Gift Voucher is issued once every 12 months on the Cardholder’s birthday (the Cardholder must have entered a valid date of birth in the relevant section of their profile prior to their birthday in order to receive this Reward). 
  12. Cardholders with ‘Loyalty Cardholder status’ are eligible to receive the following Rewards:
    1. early access to and previews of sales and extra discounts on products not available to the public.  These will be issued from time to time by Country Road/Trenery at its discretion and on such terms as it sees fit;
    2. basic tailoring on full priced suit purchases. Basic tailoring includes free shortening or lengthening of jacket sleeves and pant/skirt hems only. The tailoring service is only available in-store at Country Road and Trenery stores (excludes David Jones, Myer and Outlet). This service is not available on event days and only available on lay-bys once paid in full. Cardholders must pay for all other tailoring alterations;
    3. first to know updates;
    4. ‘Spend & Save’ offers.  These will be issued from time to time by Country Road/Trenery at its discretion and on such terms as it sees fit;
    5. free gift wrapping for in store purchases;
    6. a $30 ‘Welcome Voucher’ issued every time the Cardholder changes tier to Loyalty Cardholder status.  This Welcome Voucher expires 60 days after date of issue;
    7. a $30 ‘Birthday Gift Voucher’, which expires 30 days after date of issue.  The Birthday Gift Voucher is issued once every 12 months on the Cardholder’s birthday (the Cardholder must have entered a valid date of birth in the relevant section of their profile prior to their birthday in order to receive this Reward); and 
    8. a $30 ‘Anniversary Voucher’ issued on the Cardholder’s Anniversary, which expires 60 days after date of issue. 
  13. Cardholders with ‘VIP Cardholder status’ are eligible to receive the following Rewards:
    1. early access to and previews of sales and extra discounts on products not available to the public.  These will be issued from time to time by Country Road/Trenery at its discretion and on such terms as it sees fit;
    2. VIP tailoring, which includes basic tailoring on full priced suits as well as additional tailoring of cuffs and hems on all pants purchased in store or online at countryroad.com.au, m.countryroad.com.au, trenery.com.au and m.trenery.com.au (excludes denim and sweat pants);
    3. first to know updates;
    4. ‘Spend & Save’ offers.  These will be issued from time to time by Country Road/Trenery at its discretion and on such terms as it sees fit;
    5. free gift wrapping for in store purchases;
    6. a $50 ‘Welcome Voucher’ issued every time the Cardholder changes tier to VIP Cardholder status.  This Welcome Voucher expires 60 days after date of issue;
    7. a $50 ‘Birthday Gift Voucher’, which expires 30 days after date of issue.  The Birthday Gift Voucher is issued once every 12 months on the Cardholder’s birthday (the Cardholder must have entered a valid date of birth in the relevant section of their profile prior to their birthday in order to receive this Reward); and 
    8. a $50 ‘Anniversary Voucher’ issued on the Cardholder’s Anniversary, which expires 60 days after date of issue. 
    9. personal shopping by appointment, limited to two sessions at Country Road or Trenery retail stores.  Sessions will run for up to approximately two hours. Country Road/Trenery requires bookings to be made 7 days in advance and appointment times will be at the discretion of the participating store; and
    10. free stock transfers and standard delivery for purchases made in store (excluding concessions and outlet stores) and free standard delivery for purchases made online (excludes www.davidjones.com.au and outlet.countryroad.com.au).   Excludes international delivery.  Free stock transfers and standard delivery of purchases are not available during sales (Cardholder Program promotional events excepted).  If a Cardholder wishes to return or exchange an item, the Cardholder assumes responsibility for postage costs. Delivery of items is at Cardholder’s own risk. Only one unit per style will be transferred (i.e. multiple sizes of the same item will not be transferred).
  14. Cardholders with New Cardholder status are eligible to receive the following Rewards:
    1. early access to and previews of sales and extra discounts on products not available to the public.  These will be issued from time to time by Country Road/Trenery at its discretion and on such terms as it sees fit;
    2. basic tailoring on full priced suit purchases. Basic tailoring includes free shortening or lengthening of jacket sleeves and pant/skirt hems only. The tailoring service is only available in-store at Country Road and Trenery stores (excludes David Jones, Myer and Outlet). This service is not available on event days and only available on lay-bys once paid in full. Cardholders must pay for all other tailoring alterations;
    3. ‘Spend & Save’ offers.  These will be issued from time to time by Country Road/Trenery at its discretion and on such terms as it sees fit; and
    4. first to know updates.

MEMBERS | MEMBERSHIP

  1. Membership of the Country Road/Trenery Cardholder program is open to individuals who are aged 18 years or older with a valid email address. 
  2. When joining in-store, a sales consultant will record the individual’s full name and email address at the register. Other details may be optionally recorded.  An individual may update their membership details at any time by logging in online and clicking on the ‘My Account’ link. Applications online may be completed by following the prompts in the checkout process.
  3. An individual becomes a Cardholder as at the Activation Date.  Completion of the sign up process to the Cardholder Program is deemed acceptance of these Terms and Conditions.
  4. Once a Cardholder has completed the application process in store, their Cardholder Program card will issued directly at point of sale.  Cardholders who complete their application online are able to pick up a Cardholder Program card when next in store upon presentation of ID displaying name and address, Cardholders may nevertheless record spend and otherwise utilise the benefits of the Cardholder Program without their card by: for purchases in store, providing an alternative form of ID displaying name and address; or for purchases online, logging into their Cardholder Program account.
  5. Upon joining the Cardholder Program, a Cardholder will be allocated to a Cardholder Program tier on the basis of the transaction spend that qualified them to apply for membership.  This allocation is conducted as follows:
    1. if the Cardholder’s first transaction spend is less than AUD$750, the Cardholder will be allocated to New Cardholder status for 6 months from the Activation Date.  At the end of this 6 months, the Cardholder will change status depending on their Spend Balance.  For example, if the Cardholder makes no further transactions during this 6 months (and as such their Spend Balance remains at less than AUD$750), they will move to Cardholder Status after the 6 months;
    2. if the Cardholder’s first transaction spend is AUD$750 or more, but less than AUD$2500, the Cardholder will be allocated to Loyalty Cardholder status for 12 months from the Activation Date (unless their subsequent Spend Balance qualifies the Cardholder to move to VIP Cardholder status); and
    3. if the Cardholder’s first transaction spend is AUD$2500 or greater, the Cardholder will be allocated to VIP Cardholder status for 12 months from the Activation Date.
  6. At any time, Cardholders may only have one account to the Cardholder Program.  Cardholders may not transfer their account or Rewards to another person.
  7. Country Road/Trenery reserves the right to refuse or terminate a Cardholder’s account to the Cardholder Program without notice or reason and at its absolute discretion.
  8. It is the Cardholder’s responsibility to update their profile including email, phone and postal address. If a Cardholder has not provided or updated Country Road/Trenery with correct details, Country Road/Trenery may not be able to contact the Cardholder about their account or Rewards.
  9. A Cardholder may end their membership at any time by contacting Country Road/Trenery’s Customer Service team on 1800 801 911 (AUS) or 0800 105 655 (NZ).
  10. By joining the Cardholder Program, an individual consents to Country Road/Trenery contacting them to provide them with consumer or marketing information and notifying them of Rewards or other products and special offers.

CARD

  1. One Cardholder Program card will be issued per Cardholder on or after that Cardholder’s Activation Date.
  2. The Cardholder Program card remains the property of Country Road/Trenery at all times.
  3. A current Cardholder Program card, or alternative form of ID displaying name and address, must be presented by Cardholder for all transactions in store including (but not limited to) requests for discounts, recording of purchases, redeeming Rewards or in response to any promotional activity specific to the Cardholder Program.  A Cardholder may also be required to provide photo identification to verify their identity.
  4. When transacting online, a Cardholder must ensure they are logged into a valid account when completing the transaction in order for that transaction to contribute towards the Cardholder’s Spend Balance.
  5. Only one Cardholder Program card can be presented for each transaction.
  6. Cardholders must notify Country Road/Trenery immediately if their Cardholder Program card is lost, stolen or misplaced.  Country Road/Trenery does not accept any responsibility or liability for any loss of card or for any unauthorised redemption of Rewards.
  7. Once a purchase is attributed to a particular Cardholder’s account, it cannot be moved or credited to another Cardholder’s account.

EARNING AND REDEMPTION OF REWARDS

  1. Rewards which take the form of Vouchers or Gift Vouchers are credited to a Cardholder’s account and may be redeemed at any Country Road or Trenery store in Australia and New Zealand (excluding Country Road Outlet stores), online (excluding outlet.countryroad.com.au and www.davidjones.com.au) or on Country Road or Trenery merchandise in David Jones and Myer concessions (excluding towels) during that Reward’s validity period.  
  2. Rewards may only be redeemed once on Country Road or Trenery merchandise unless stated otherwise.
  3. To redeem any applicable Reward when transacting online, a Cardholder must ensure they are logged into a valid account.   When redeeming any applicable Reward, the Reward will be applied proportionally across each item purchased, based on the percentage each item’s represents of your total purchase. This will mean that the Reward will not be split equally across all items.
  4. Rewards are not redeemable for cash and cannot be exchanged for or used to purchase gift cards. Rewards cannot be redeemed against a prior purchase or an existing lay-by. No change (whether monetary or in specie) will be issued should the redeeming transaction be less than Reward.
  5. Rewards are subject to Country Road/Trenery’s Websites’ terms and conditions and delivery, returns and privacy policies.
  6. If a Cardholder wishes to return a purchase for reasons other than that the goods are faulty or misdescribed:
    1. any Reward redeemed or utilised during the purchase (i.e. discount from Spend & Save offer) will be forfeited; and
    2. any Reward that may otherwise have been obtained (such as through being promoted to a higher tier) will be kept but the Cardholder will have the value of the return transaction deducted from their Spend Balance.  This may result in the Cardholder having a negative Spend Balance.
  7. If a Cardholder wishes to exchange a purchase for reasons other than that the goods are faulty or misdescribed and the exchange item is a product of lesser value than the initially purchased item:
    1. any Reward redeemed or utilised during the purchase (i.e. discount from Spend & Save offer) will be forfeited; and
    2. any Reward that may otherwise have been obtained (such as through being promoted to a higher tier) will be kept but the Cardholder will have the value of the difference between the initial item and the exchange item deducted from their Spend Balance.  This may result in the Cardholder having a negative Spend Balance.
  8. Rewards may have an expiry date at which point they will no longer be available for redemption. Country Road/Trenery reserves the right to change the expiry date of any Reward at any time without notice.
  9. Country Road/Trenery reserves the right in its absolute discretion to exclude Rewards from being used in conjunction with any other offer or to exclude certain items and promotions from being redeemed using Rewards.
  10. Rewards may entitle Cardholders to receive offers, special discounts and entry into competitions which are themselves subject to further terms and conditions.  These terms and conditions will be available at the time of each offer, special discount or competition and may vary from time to time.
  11. Country Road/Trenery will endeavour to notify the Cardholder via email of their entitlement to any Rewards.
  12. Country Road/Trenery reserves the right to withdraw, cancel or vary any Reward awarded to any Cardholder(s) without notice and at any time.
  13. In cases where Rewards are for a single use only, forfeiture of that Reward does not entitle the Cardholder to have that Reward renewed and a new Reward will not be issued in its place (unless otherwise required at law). 
  14. The currency in which Rewards are redeemed will be based on the location of the redeeming store. For example, a store based in New Zealand will redeem the Rewards in NZD. The Country Road/Trenery online store is based in Australia and consequently, will redeem Rewards in AUD.
  15. Rewards can only be earned or redeemed in the country of membership origin. For example, if a customer joins the Country Road/Trenery Cardholder program in Australia, Rewards can only be redeemed in Australian stores.  For the avoidance of doubt, Cardholders who reside outside of Australia or New Zealand (i.e. international Cardholders) are deemed, for the purposes of earning and redeeming Rewards, to be of Australian membership origin.
  16. If a Cardholder’s account is deactivated from the Cardholder Program, all accrued Rewards will no longer be valid and no Rewards will be issued to that account in the future.
  17. Country Road/Trenery is not responsible or liable if Rewards are not able to be redeemed for whatever reason including but without limitation in the case of Technical Issues.
